esure App Terms

PART 1 – OVERVIEW OF APP

1. The App
1.1. The esure mobile application (the "App") is an online platform which has been developed and made available in collaboration with a company that we work with called Caura. The App aims to make managing your insurance and car-related matters effortless by allowing you to manage and track everything in one place.
1.2. For the purposes of these terms & conditions (referred to as “terms”) "We" “our” and “us” refers to "esure" and “Caura” refers to “Caura Ltd”. For more information about us or Caura see part 2 and 3 of these terms below.
1.3. By using the App, you acknowledge that you have read, understood, and agree to these terms. Your use of the App is subject to compliance with all applicable laws and regulations.
1.4. We and/or Caura may receive a fee or commission from some third-party providers when you use or purchase their services via the App.
1.5. The functions

  • Insurance Services
  • 1.5.1. The App provides a quick and easy way for you to view and manage your esure car and home insurance policies. You’ll be able to see all your policy documents, make changes to your insurance and manage renewals, all in one place (the “Insurance Services”). The Insurance Services in the App are provided and managed by us.
  • Caura Services
  • 1.5.2. The App also offers a variety of features provided by Caura to make managing your car easier. You can handle car related tasks, including booking, managing and paying for services such as airport parking, car-maintenance, MOT and paying your car tax or road tolls.) (“Car Services”). The App can also send you expiry reminders for your insurance policy, tax and/or MOT.
  • 1.5.3. All Car Servies in the App are provided and managed by Caura. When you book a Car Service, you are entering into a contract directly with Caura and/or their carefully selected suppliers.

2. Key Terms
2.1. Use of the App is subject to these terms. The App is for your personal use only and it may not be used for any commercial purposes.
2.2. The App is provided on an “as is” basis. Some information is provided by esure and some information is provided by Caura and/or their third party suppliers and we don’t guarantee that all the information provided on it is up to date or accurate at all times. This statement does not apply to your core insurance documents, such as your certificate of insurance or policy schedule. These documents are accessible through the App for reference and use. If you see any discrepancies in your core insurance documents, please contact us immediately for assistance. You can do this by visiting https://www.esure.com and clicking Need Help. Alternatively, you can chat with us directly in the App by:

  • 2.2.1. in the ‘Vehicle’ tab, choose your policy
  • 2.2.2. go to ‘Account’ at the bottom right of the screen
  • 2.2.3. select ‘Need help?’
  • 2.2.4. choose ‘Contact us’ to speak to esure.


2.3. We accept no liability for inaccuracies or omissions in the App. We recommend that you check the accuracy and completeness of any information before relying on it. This statement does not apply to your core insurance documents, such as your certificate of insurance or your policy schedule. These documents are accessible through the App for reference and use. If you see any discrepancies in your core insurance documents, please contact us immediately for assistance.
2.4. Caura license the use of the App to you on the basis of these terms and subject to any rules or policies applied by us, Caura and/or any Appstore Provider from whose site you downloaded the App.

3. How does the App work
3.1. The App is an online platform, made available by Caura on behalf of esure.
3.2. The Insurance Services, managed by esure, allow you to view your policy, make updates and renew your coverage when it’s time to do so. We will use the account information that you have already given us as your insurer. This will include details such as your name, contact information, policy details and any other information needed to provide and manage the App. By using the App, you agree that we may access and use this information in this way. We will always handle your data securely and in accordance with data protection laws.
3.3. If you’re looking for a new policy, the App also provides access to purchase a new car or home insurance policy.
3.4. The App doesn’t currently include any functionality to manage your travel insurance, so you won’t be able to see any travel policy bought via esure in the App.
3.5. The Car Services functions, managed by Caura, can provide timely reminders when your car tax, MOT and/or service is due. You’ll also be able to check whether you’re exempt from certain car city charges and book parking at major UK airports.
3.6. All trademarks appearing in the App (for example OEM logos) are the property of their respective owners and their appearance in the App in no way implies any affiliation with the owners.

4. Who can use the App?
4.1. The App is free for our customers who have an active esure car or home insurance policy. Once your insurance with esure ends, you will no longer be able to use the Car Services on the App. If you’ve made any in-app bookings or purchases (for example if you’ve booked airport parking for a future date), you will still be able to access and view these bookings. You’ll also receive email confirmation in respect of any booking you make through the App.
4.2. You may only use and access the App on your own behalf and not on behalf of anyone else (unless you have their express permission to do so).
4.3. You are welcome to download and use the App if you agree to comply with these terms and you:

  • 4.3.1. are over 17 years old;
  • 4.3.2. are a real, live person accessing our services for your personal use (you can’t use our App for commercial or business purposes); and
  • 4.3.3. live in the United Kingdom


4.4. Your App will be linked to the same email address that is active for your esure account.

5. Downloading the App and your profile
5.1. If you download the App onto any phone or other device not owned by you, you must have the owner's permission to do so. You will be responsible for complying with these terms, whether you own the phone or other device or not.
5.2. In order to use the App you will need internet access. You may be charged by your service provider for internet access on the device you use to access the App. You accept responsibility in accordance with these terms for the use of the App on or in relation to any device, whether it is owned by you or not.
5.3. Your esure app account details are confidential. You are responsible for maintaining the security of your account and you are fully responsible for all activities that occur under the account and any other action taken in connection with it.
5.4. If you add a vehicle which is not insured with esure to your App, you must have the explicit consent of the registered keeper of the vehicle. You are responsible for ensuring you continue to have this consent. We or Caura may request evidence of this consent at any time. If you update your vehicle registration plate then you must add the new plate as a new vehicle, you are solely responsible for any consequences of not updating and maintaining accurate vehicle information, such as penalties or fines.
5.5. You must immediately notify Caura of any unauthorised use of your account or any other breaches of security. Please email: [email protected]

6. Appstore provider and operating system requirements
6.1. The App is available on the Google Play Store and the Apple App Store (the “Appstore Providers”). The ways in which you can use the App may also be controlled by the Appstore Provider’s rules and policies. We encourage you to read those rules and policies and ensure that you comply with them. If there are any differences between these terms and the Appstore Provider’s policies, the latter will apply.
6.2. You acknowledge that these terms are concluded between you, us and Caura, and not with the Appstore Provider. Caura are solely responsible for the App and its content, not the Appstore Provider. The Appstore Provider has no liability whatsoever to you under these terms or in relation to the App.
6.3. The App requires either Apple iPhone running iOS 12 or later, or Android phones running Android 9 or later.

7. Updates to the App
7.1. We may update the Insurance Services available in the App from time to time however your core insurance documents including policies, certificates and related records will always remain accessible to you regardless of any updates or changes to the App. You can view, download or manage these documents at any time by logging in to your esure Account on our website at http://www.esure.com/login
7.2. Caura may update the general App functionality and change the Car Services available on the App from time to time to improve performance, enhance functionality, reflect changes to users’ needs or to address security issues. Alternatively, we or they may ask you to update the App for these reasons. If you choose not to install such updates or if you opt out of automatic updates you may not be able to continue using the App.
7.3. If the App is updated, we may update these terms as set out at paragraph 18 below. We will notify you if we do this.

8. Licence restrictions
8.1. The App is made available free of charge on a non-exclusive, non-transferable basis for your personal, non-commercial use only. This means that you cannot make money from your use of the App.
8.2. You agree that you are solely responsible for any costs and expenses you may incur in relation to your use of the App.
8.3. You agree that you will:

  • 8.3.1. not rent, lease, sub-license, loan, provide, or otherwise make available, the App in any form, in whole or in part to any person without prior written consent from us;
  • 8.3.2. not copy the App except as part of the normal use of the App or where it is necessary for the purpose of back-up or operational security;
  • 8.3.3. not translate, merge, adapt, vary, alter or modify, the whole or any part of the App nor permit the App or any part of it to be combined with, or become incorporated in, any other programs, except as necessary to use the App on devices as permitted in these terms;
  • 8.3.4. not disassemble, de-compile, reverse engineer or create derivative works based on the whole or any part of the App nor attempt to do any such things, except solely to the extent such actions cannot be prohibited by law;
  • 8.3.5. comply with all applicable technology control or export laws and regulations that apply to the technology used or supported by the App; and
  • 8.3.6. not remove, alter, or obscure any copyright, trademark or other proprietary notices appearing in or on the App.

8.4. You may only use the App for lawful purposes. You must not access or use the App (or any of the Insurance Services, Car Services or other content made available through the App):

  • 8.4.1. in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with these terms, or act fraudulently or maliciously, for example, by hacking into or inserting malicious code, such as viruses, or harmful data, into the App or any operating system;
  • 8.4.2. in a way that infringes our or Caura’s intellectual property rights or those of any third party (to the extent that such use is not licensed by these terms);
  • 8.4.3. to transmit any material that is defamatory, offensive or otherwise objectionable in relation to your use of the App;
  • 8.4.4. in a way that could damage, disable, overburden, impair or compromise our systems or security or interfere with other users;
  • 8.4.5. to collect or harvest any information or data from the App or our systems or attempt to decipher any transmissions to or from the servers running the App;
  • 8.4.6. to access or interfere with another user's account or information, impersonate another person or create or use a false identity or contact details; or
  • 8.4.7. in any way that is not authorised by us or is detrimental to us or our third-party service providers.

 

PART 2 – ESURE SERVICES

9. Who are we
9.1. esure is a trading name of esure Group plc (company number 07064312) and its subsidiaries which include esure Services Limited (company registration number 02135610) and esure Insurance Limited (company registration number 03885534).
9.2. We are authorised and regulated by the Financial Conduct Authority (FCA) The firm reference number for esure Services Limited (an insurance intermediary and credit broker) is 312063 and the reference number for esure Insurance Limited (an insurance provider) is 203350. You can check this information by visiting the FCA website at fca.org.uk/register or by contacting the FCA on 0800 111 6768.

10.1. We offer the following insurance products and services. You will be able to browse and purchase these products through the App. The specific terms and conditions for each product including pricing, cover levels and any exclusions will be provided to you at the time of purchase.

10.4. By using the App, you acknowledge and agree that:

  • 10.4.1. The insurance products we offer may vary over time and you will be provided with all relevant details before completing a purchase.
  • 10.4.2. You will have the opportunity to review and accept the terms and conditions applicable to any insurance you buy through the App before proceeding with that purchase. You can also chat to us directly in the App.
  • 10.4.3. The general use of the App does not obligate you to renew or purchase any insurance (or other) products or services, including the Car Services.
     

11. esure’s Liability
11.1. The App includes links to and integrates with products and/or services offered by third parties, managed by Caura. esure does not control, endorse or assume liability for any third-party products, services or content accessed through the App. esure will not be liable to you for any loss, damage or claims arising from or in connection with third party services or reliance on third party content.
11.2. Any liability relating to your insurance policies, documents or services are governed by the terms and conditions of the relevant policy. These other terms and conditions will always be provided to you at the time of purchase and should be referred to for details of coverage, exclusions and any limitations on our liability.
11.3. These terms do not amend, extend or limit the terms and conditions of your insurance policies.
11.4. The general liability provisions in relation to the App are set out at paragraph 22 below.
11.5. If you decide to enter into a contract with one of Caura’s suppliers for Car Services through the App, the information you have provided to us, together with any further information requested by, and supplied by you or us to the Caura supplier, will be held by Caura and their supplier for the purposes set out in their privacy policies. They will act as a controller of your personal information. Therefore, you must read the relevant suppliers own privacy policy and satisfy yourself as to the purposes for which they will use your personal information before entering into the contract. We have no responsibility for the uses to which Caura and its suppliers puts your personal information and will not be liable for data protection issues arising from how Caura or their suppliers handle your data.

PART 3 – CAURA SERVICES

12. Who are Caura
12.1. Caura Ltd are registered in England and Wales under company number 11520538 and their registered office is at 1 Horse Guards Avenue, London, England, SW1A 2HU.

13. Caura functions in the App
13.1. Caura’s services

  • 13.1.1. Caura aims to make car-related matters effortless by allowing you to manage and track them in the App.


13.2. Payments to third party service providers

  • 13.2.1. The App allows you to make payments to other service providers for Car Services including, but not limited to:
    • 13.2.1.1. Garages (e.g. for an MOT or to book a service);
    • 13.2.1.2. Statutory charges (e.g. London’s Congestion Charge, London’s ULEZ Charge, Vehicle Excise Duty, Clean Air Zone charges); and
    • 13.2.1.3. Toll charges (e.g. Dart Charge).

  • 13.2.2. When you use the App to purchase a service from a third-party provider, you will appoint Caura to purchase that service in your name from the relevant third party. Caura will do this by communicating your details to the third party.
  • 13.2.3. You acknowledge that Caura will be authorised (under these terms) to conclude the purchase of any third-party service you have selected on your behalf, so once they communicate your details to the third-party, this is essentially the same as if you had communicated them directly to the third party yourself. The resulting purchase will be between you and the third party directly. For example, if you book an MOT with a garage via the App, you will be contracting directly with the garage. Caura solely conclude your purchase of the service, they do not perform it or act on behalf of the third party.
  • 13.2.4. If you experience any issues relating to the third-party services you purchase via the App, you must contact the relevant provider directly. Caura have no liability to you for any acts, omissions, errors or defaults of the providers in connection with the services.
  • 13.2.5. In respect of payments for any third-party services, Caura will act as your agent for those payments. Caura will settle the amount due for the purchase of services on your behalf, and you will reimburse Caura for the full amount. Caura use a third-party payment service provider, Stripe, to process payments for services purchased through the App.
  • 13.2.6. Neither Caura (or esure) are responsible for processing refunds for Statutory charges and Toll charges. Refunds are dependent on Caura’s discretion and the policy of the relevant provider.


13.3. Special terms and conditions for Car Services provided by Caura

  • 13.3.1. The terms and conditions for each service provided by Caura are below. We’ll provide these again when you purchase a service in the App.
    • 13.3.1.1. Caura Drive
    • Caura Drive allows you to make payments to pay tolls and other statutory car charges. This includes, but is not limited to, statutory charges (London’s Congestion Charge, London’s ULEZ Charge, Vehicle Excise Duty, Clean Air Zone Charges, etc.) or toll charges (e.g. Dart Charge, Heathrow Drop-off Charge) You can view the Caura Drive terms and conditions at caura.com/terms/drive
    • 13.3.1.2. Caura Maintain
    • Caura Maintain enables you to book car maintenance within the App at a range of garages nationwide. This includes MOTs, servicing, and repairs.
    • 13.3.1.2.1.1.1. When you book car maintenance within the App you will be able to:
      • 13.1.1.1.1 select a garage;
      • 13.1.1.1.2 select your works, and
      • 13.1.1.1.3 select when you would like to drop off your car.
    • 13.1.1.2 If you request a booking within the App. Caura will send your booking details (including your registration number) to the garage to request a booking which the garage can accept.

14. Airport Parking
14.1. You can book parking at most airports around the UK within the App.
14.2. You can view the Airport Parking terms and conditions at http://caura.com/terms/airportparking

15. Intellectual Property
15.1. All intellectual property rights in the App belong to Caura (or their licensors) and the rights in the App are licensed (not sold) to you. You have no intellectual property rights in, or to, the App other than the right to use them in accordance with these terms.

16. Open-source software
16.1. If any open-source software is included in the App, the terms of an open-source licence may override some of the terms of these terms.

17. Caura’s Liability
17.1. Caura does not control, endorse or assume liability for the Insurance Services (or in relation to your insurance policies). Caura will not be liable to you for any loss, damage or claims arising from or in connection with your insurance policies.
17.2. The general liability provisions in relation to the App are set out at paragraph 22 below.

PART 4 – MISCELLANEOUS TERMS

18. Changes and updates to these T&Cs
18.1. We may amend these terms from time to time, for example, to reflect changes in law, the functionality of the App or the services offered through it. We will notify changes to these terms in advance via push notifications or any other manner we deem appropriate. Your continued use of the App will confirm your acceptance of the revised terms. Please check the terms regularly to ensure you understand the terms that apply at that time.

19. Transferring rights
19.1. All Insurance Services, including your policy and contractual arrangements with esure will not be transferred to another party. Your contractual relationship for Insurance Services remains solely with esure as specified in your insurance documents.
19.2. Caura may transfer their rights and obligations under these terms (relating to the provision of Car Services) to another organisation. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your insurance documents in any way.

20. You need our consent to transfer your rights to someone else
20.1. You may only transfer your rights or your obligations under these terms to another person if we agree in writing.

21. Termination of these terms and exit arrangements
21.1. Your rights to use the App will end once you are no longer an esure customer. If you have purchased any third party services in the App, you will still be able to access these after your esure policy has ended however you will not be able to make any new purchases or bookings and you will not be able to access the Insurance Services within the App.
21.2. We may end your rights to use the App if you break these terms.
21.3. We reserve the right at any time to terminate your agreement with us and your use of the App, with or without cause, immediately upon giving you notice in writing to the email address provided by you when you registered for your account (or any subsequent email address you provide). In particular, we may do this if:

  • 21.3.1. you use the App in a manner that is deemed by us to be contrary to these terms or fraudulent; or
  • 21.3.2. if we stop providing the Caura App.


21.4. In such instances, we are not liable to you for the cost of any services purchased by you through the App which you are no longer able to access or use as a result of your account being deleted or suspended.
21.5. If you no longer wish to use the App, you can close and delete your app account by emailing your request to [email protected]. Please note that once deleted, your app account cannot be recovered. This will not affect your insurance policy or any of the data that esure holds. For more information about how we and/or Caura handle your data please review the privacy policies.

22. General Liability
22.1. Neither esure or Caura will be liable to you or any third party for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty or otherwise, even if foreseeable, arising under or in connection with:

  • 22.1.1. use of, inability to use or unavailability of the App (or any part of it);
  • 22.1.2. use of any products, data, information or services accessed or obtained, or messages received or transactions entered into, through or from the App, including use of or reliance on any content displayed on or made available through our App. This statement does not apply to your core insurance documents, such as your certificate of insurance or your policy schedule. These documents are accessible through the App for reference and use. If you see any discrepancies in your core insurance documents, please contact us immediately for assistance.
  • 22.1.3. unauthorised access to or alteration of your transmissions or data; or
  • 22.1.4. any inaccuracy, omission or incompleteness of any information received by you or by us through the App


22.2. Nothing in these terms excludes or limits our or Caura’s liability for death or personal injury arising from our negligence, or our or Caura’s fraud or fraudulent misrepresentation, nor any other liability that cannot be excluded or limited under applicable law.
22.3. To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to the App, any content on it or services accessed through it, whether express or implied.
22.4. Any reliance that you may place on the information on the App is at your own risk. We recommend that you check the accuracy and completeness of any information before relying on it. Caura may from time-to-time automatically populate information such as your MOT renewal date, this information is intended to be helpful but we nor Caura bear any responsibility for the accuracy of such information. You are responsible for ensuring that your vehicle remains compliant with laws and regulations.
22.5. Although we and Caura take all reasonable steps to protect our systems using virus checking software, please note that any content downloaded from our App is at your own risk. Neither esure or Caura accept liability for any loss or damage that you suffer as a result of any distributed denial-of-service attacks, computer viruses, Trojan horses, worms, software bombs or other damaging items resulting from your use of our App. You are responsible for protecting your hardware, software, data and other material (including your phone, or tablet and any other devices which may be relevant) from exposure to viruses by the use of anti-virus software, firewalls and any other technical measures necessary.
22.6. If you download the App or other digital content provided by us and you suffer damage to your device or other digital content you own because we have not exercised reasonable care and skill in creating such digital content, you may be entitled to compensation or repair pursuant to your statutory rights.
22.7. We do not guarantee the availability of the App. As with any service provided over the internet or a mobile network, there are factors over which we have no control, for which we cannot accept liability. We may suspend, withdraw or restrict the availability of all or any part of the App where we consider that this is necessary for maintenance or any other business or operational reasons without any prior notice or liability to you.
22.8. We shall not be liable for any delay or failure to provide services or perform any obligation under these terms. Your insurance documents will be available to you in your Account on our website if you are not able to access them in the App for any reason.
22.9. We do not charge you a separate fee for access to and use of the App. On this basis, esure’s total aggregate liability for any losses and/or damage suffered by you will be limited to £50.
22.10 We are not responsible for other websites we link to

  • 22.10.1 The App and the services made available to you via the App may contain links to independent websites which are not provided by us or Caura. These independent sites are not under our or Caura’s control and we are not responsible for and have not checked and approved their content and/or their privacy policies (if any). You will need to make your own independent judgement about whether to use such independent sites, including whether to buy any products or services offered by them


23. Rights of third parties
23.1. If you have downloaded our App from the Apple App Store or Google Play Store, you acknowledge that Appstore Providers may enforce the provisions of these terms against you as a third-party beneficiary in accordance with the Contracts (Rights of Third Parties) Act 1999 (“Act”). Otherwise, nothing in these terms is intended to confer on any person any right to enforce any term of these terms which that person would not have had but for that Act.

24. Illegality
24.1. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

25. Enforceability
25.1. Even if we delay in enforcing this contract, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.

26. Whole agreement
26.1. These terms constitute the whole agreement and understanding between you, us and Caura in relation to the use of our App. Except in case of fraud, all previous agreements, understandings, undertakings, representations, warranties, promises and arrangements between you and us relating to the subject matter of these terms or your use of our App are superseded, except as otherwise expressly stated in these terms.

27. Notices
27.1. You agree that any notices and other communication may be given by us by email or posted on our App and this will comply with any legal requirement for such communications to be in writing. You also agree that any notice or other communication made in such manner will be deemed received by you 24 hours after email or posting.

28. Applicable law and jurisdiction
28.1. These terms are governed by English and Welsh law and you can bring legal proceedings in respect of the products in the English and Welsh courts. If you live in Scotland you can bring legal proceedings in respect of the products in either the Scottish or the English and Welsh courts. If you live in Northern Ireland you can bring legal proceedings in respect of the products in either the Northern Irish or the English and Welsh courts.
28.2. The headings used in these terms are for convenience only and shall not affect their interpretation. In these terms, unless specified otherwise, use of the singular includes the plural, use of any gender is deemed to include every gender and any reference to a person includes a corporation, a partnership and any other body or entity, and vice versa. Use of the words, includes or including or similar words or phrases means without limitation and the use of these or similar words or phrases shall not limit the meaning of the general words.

29. Support and complaints
29.1. Esure complaint
29.2. If you have a complaint about the Insurance Services, or anything relating to your insurance policy you can chat with one of our agents, through our live chat service. To access this in the App you can:

  • 29.2.1. open the App;
  • 29.2.2. in the ‘Vehicle’ tab, choose your policy;
  • 29.2.3. go to ‘Account’ at the bottom right of the screen
  • 29.2.4. select ‘Need help?’
  • 29.2.5. choose Contact us to speak to esure

PART 5 – DATA PROTECTION

31. Data Protection and Privacy
31.1. We are committed to protecting your privacy and handling your personal data in compliance with applicable data protection laws, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
